1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client") and ENSO-SINGAPORE HOLDINGS PTE. LTD., operating as Get Brand Exposure ("Company," "we," "us," or "our"), concerning your access to and use of start.getbrandexposure.com and all associated services (the "Services").

By accessing our website or engaging our services, you confirm that you have read, understood, and agreed to be bound by these Terms. We reserve the right to modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

2. SMS / Text Messaging Communications

Description of SMS Program: Get Brand Exposure uses SMS (text messaging) to communicate with clients and prospects for the following purposes:

  • Appointment reminders and scheduling confirmations
  • Lead qualification and follow-up messages sent on behalf of our clients
  • AI-powered SMS outreach campaigns (Database Reactivation / lead reactivation) conducted through our automated systems
  • Service updates, campaign performance notifications, and onboarding communications
  • Customer support responses

Consent: By providing your phone number and engaging with our services, you expressly consent to receive SMS messages from Get Brand Exposure and/or messages sent on behalf of our clients through our platforms. Standard message and data rates may apply.

Message Frequency: Message frequency varies depending on service engagement and campaign activity. You may receive up to several messages per week.

Message & Data Rates: Standard message and data rates may apply based on your mobile carrier plan. Get Brand Exposure is not responsible for any charges applied by your carrier.

3. Opt-Out Instructions

You may opt out of SMS communications at any time using any of the following methods:

  • Text STOP to any SMS message you receive from us to unsubscribe immediately
  • Text HELP to any SMS message to receive assistance and support contact information
  • Email us at [email protected] and request removal from our messaging list
  • Call us at +1 302 200 5528 to request opt-out

After opting out, you will receive one final confirmation message. You will not receive further SMS messages unless you provide new consent.

4. Carrier Liability Disclaimer

Get Brand Exposure's SMS messaging services are provided through third-party telecommunications carriers. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier network availability and conditions outside our control. We do not guarantee delivery of all SMS messages and are not responsible for any failure to deliver messages due to carrier issues, network outages, or incorrect phone numbers provided by users.

5. Client Access and Data

We grant you a non-exclusive, non-transferable right to access and use the Services for your internal business purposes. You retain ownership of your business data uploaded to our systems. We may use your data solely to deliver the contracted Services and will not sell or share it with third parties except as required by law.

All AI-generated learning, models, and optimizations derived from delivering our Services remain the intellectual property of Get Brand Exposure / ENSO-SINGAPORE HOLDINGS PTE. LTD.

6. Client Representations

By using our services, you represent and warrant that:

  • You are 18 years of age or older
  • All information you provide is true, accurate, and complete
  • You will comply with all applicable laws, including the TCPA (Telephone Consumer Protection Act) and relevant data protection regulations
  • You have obtained all required consents from your own customers/prospects before providing their contact data to us for outreach campaigns
  • Your use of the Services will not violate any applicable law or regulation
  • You will not use the Services for any illegal or unauthorized purpose

7. Intellectual Property

All content, software, designs, trademarks, and materials on our website and within our service platforms are the exclusive property of ENSO-SINGAPORE HOLDINGS PTE. LTD. / Get Brand Exposure and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.

8. Prohibited Activities

You agree not to:

  • Use the Services to harass, abuse, or harm any person
  • Use the Services for any illegal or unauthorized purpose
  • Transmit viruses, malware, or other harmful code
  • Attempt to reverse engineer or gain unauthorized access to our systems
  • Use our Services to compete directly with Get Brand Exposure
  • Send unsolicited messages to individuals who have not provided consent

9. Cancellation & Termination

Either party may terminate service engagement with written notice as specified in the applicable service agreement. Upon termination, you remain liable for all fees incurred up to the effective termination date. We reserve the right to suspend or terminate access to our Services immediately for breach of these Terms.

10. Confidentiality

Both parties agree to keep confidential any non-public information shared during the course of the service relationship, including but not limited to business strategies, client lists, pricing, and proprietary systems. This obligation survives termination of the service relationship for a period of three (3) years.

11. Warranty Disclaimer

Services are provided "as is." To the maximum extent permitted by law, Get Brand Exposure disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific results from our services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Get Brand Exposure and ENSO-SINGAPORE HOLDINGS PTE. LTD. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount paid by you in the six (6) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Get Brand Exposure and ENSO-SINGAPORE HOLDINGS PTE. LTD. from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your breach of these Terms, or your violation of any third-party rights.

14. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, available at start.getbrandexposure.com/privacy-policy. By using our Services, you consent to the practices described therein. Our Services are operated from Singapore; if you access them from another jurisdiction, you consent to the transfer and processing of your data under applicable laws.

We employ reasonable administrative, technical, and physical safeguards to protect your data. We will use your data solely for the purpose of delivering our Services and will not share, sell, or transfer your data to third parties except as required by law or as necessary to provide the Services.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of Singapore. Any disputes arising from these Terms or the Services shall first be subject to good-faith informal negotiation for thirty (30) days. If unresolved, disputes shall be settled by binding arbitration in Singapore in accordance with the Singapore International Arbitration Centre (SIAC) Rules.

17. Force Majeure

Neither party shall be held responsible for delays or failures in performance caused by circumstances beyond reasonable control, including natural disasters, war, government actions, or disruptions to internet or telecommunications infrastructure.

18. Electronic Communications

By using our Services, you consent to receive electronic communications from us. You agree that all notices, disclosures, and agreements provided electronically satisfy any requirement that such communications be in writing.

19. Miscellaneous

These Terms constitute the entire agreement between you and Get Brand Exposure regarding the Services. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right does not constitute a waiver of that right.
